FDA Responds To Vapor Lawsuits

Earlier this year the FDA released the final deeming regs which is already starting to cripple the vaping industry. Even though most of the new regulations won't take full effect for two years, vape shop owners and manufacturers everywhere are closing their doors to avoid jumping through all the hoops and paying the outrageous fees to stay in the market. 

It didn't take long for a few lawsuits to be filed against the FDA. At one point there were over nine groups with lawsuits filed. Several of the lawsuits were recently ordered to be consolidated by a federal judge. Nicopure labs and The Right to be Smoke-Free Coalition are now fighting together under one umbrella and this is the FDA's 101 page response to the case.

If you don't have the time to read through this short novel here's how it reads:

  • They claim that e-liquid has dangerous compounds in it
  • Mods are exploding in people's faces
  • Nicotine is the most addicted substance known to man
  • The FDA has a lot of money to throw at lawsuits
  • The FDA can be extremely smug when it comes to dealing with the vaping industry

To those of us who have read (and lived) through all the vaping success stories, this response comes off as more of a fear mongering tactic and misinformation campaign for the general public to consume. There isn't really a whole lot of fact based information to justify such a harsh plan to wipe out an entire industry.

If this case does see the light of day in court, it's going to be an uphill battle for us just clearing up all the unjust claims that the FDA has made to the public. What are your thoughts on the FDA's response? Shoot us a comment below and let your voice be heard!

The claims on here are false. E-liquids have the same compounds that are FDA-approved food additives, if they are harmful then why be in the food that we eat? Second claim is false as well, the only reason a mod would explode is if the battery isn’t providing the right current and in that case the person is at the wrong, not the vape. Thirdly Nicotine isn’t the most addictive substance on the planet, alcohol and caffeine are. You don’t see anyone going after those products.
I myself had smoked cigarettes for 22 years , Vaping helped me quit smoking in a week. I can’t even stand the smell of cigarettes anymore. If anything I believe that it was a Godsend to get me and my family off of those deadly things (cigarettes) that The FDA wants people to be addicted to so they can take our money and our health, which puts more money into their pockets. I agree with Tim Swan, the FDA Tobacco needs to be held in contempt for not telling the truth under oath. Thank you Lord for vaping. Enough said.

I smoked for 35 yrs. I had quit a few times w the aid of drugs the fda approved and the gums available. It never lasted and the side effects were horrible!!! I smoked my last cig on may 27th at noon of this yr. Stopped at a vape shop instead of a gas station for a pack. I have not had a cig since that day. I feel great, no asthma attacks, BP has dropped, no withdrawl…i also dont smell like smoke. I know vape 0-3mgs…mostly 0. The FDA is corrupt & getting a kick back from somewhere!!!! Thank you vape industry for saving me!!!

I may live in Canada but all vapers are family, so it really bugs me when big companies complain about a product that is saving lives. They are not getting any profit and they see that it is actually a good investment and want a peice of the pie too. I for one smoked over 23 years and vaping saved my life!!! I don’t get sick as often and have not had a problem with my asthma since. 8 months smoke free and I feel wonderful. So don’t tell me it is harmful cause I myself and all the vaping family know ad well too…. VAPING SAVES LIVES!!!!!!!!!!!!!!

Smoked heavily for 30 years—never lasted more than 2 days in the 10-15 times I tried quitting. I got a regulated mod as a Christmas gift last year and have not smoked, nor have i wanted to smoke, a single cigarette since. The FDA is a disgrace. Laying in bed with big tobacco sharing a cigarette after giving it good to the very people it purports to protect. Spineless puppets. Gross.

I’ve been vaping for 4 years I feel better for and I agree with all these comments especially exploding mods I’ve had 3 mods and not one has exploded. Just morons using them wrong. Fda does not no a god damn thing no proper test to say vaping is harmful. We the people choose to vape it’s not your right to tell us we can’t. Rant over

I’m almost a year smoke free due to vaping. Although I’m Dutch this is not my direct fight, but I can’t stand here and watch false claims being thrown out in the wild and let the corruption win.
My health is way beyond I could have hoped for, even for the first time in my life instead of losing weight I’m gaining weight in a healthy way. Something which didn’t happen during smoking.
I hope that eyes are opened and that people look beyond the lies.

Smoked for 11 years…found vaping 4 years ago and never looked back. I feel a thousand times better and don’t smell like an ashtray. Thank you FDA for forcing the public to go back to cigarettes….you obviously care about the well being of people.

I have been Vaping for almost 2 years I Can Officially say that it saved My Life I can breathe easier… I don’t feel an elephant sitting on my chest anymore as I did with Cigs…. It Helped me and my 67 year old Godmother Quit Cigs! And We Enjoy Vaping And Like To Tell Others That It Helped us In many ways… And another Note Mods dont just blow up for no reason there is a reason behind it which is the person isn’t using it the correct way… If you use it the correct way then YOU have no problem at all…

I was a smoker for 20 years I was smoking a pack a day. I would wake up wheezing in middle of the night and have to use a nebulizer so I could breathe and go back to sleep. I got colds all the time and they would last weeks and 9 times out of 10 they would turn into bronchitis. I tried a lot of Things to quit smoking patches, gum, and 2 different kinds of meds one of them being Chantix I went into a severe depression and at one time actually thought about suicide I was at my end then one day picked up a e-cig and I have been smoke free for 2 years I have never felt better I don’t get cold very often any more and they only last a few days I can run and keep up with my 7 year old son Vaping gave me back my life and gave my son his mother back.

Having been a smoker for over 25 years, this coming Sept. 12th will mark my 5th year smoke free! My success is solely due to vaping. After trying all of the “FDA approved” methods, none worked, not even cold turkey. What the FDA doesn’t realize is that smoking is more than just nicotine addiction. We are also addicted to the numerous chemicals in tobacco including those that are added as a result of regulation of tobacco. Addiction also is the hand to mouth habit. The FDA and anti-smoking groups do not understand why people smoke. Vaping is able to bridge the gaps that the other cessation methods do not take into account. The recent decrease in smoking rates is a direct relation to the growth of vaping. I have helped MANY quit smoking by introducing them to vaping. A key part of vaping is the sense of “community” and helping one another. If the FDA really cared about helping people, they would embrace the 1,000s of success stories and seek to help boost the industry, yet they are doing everything to kill the industry! Leaves a lot of room to question the motivation behind the FDA deeming rules.
